Der Autor klärt anhand normentheoretischer Grundlegung das Verhältnis von Straf- und Verwaltungsrecht, wo verwaltungsrechtliche Verhaltensregeln strafbewehrt sind, wie in weiten Teilen des Neben- und dort vor allem des Umweltstrafrechts. Strafrecht hat als teilweise sekundäres Recht nicht die Aufgabe, Bürgerverhalten zu regeln, soweit das bereits andere Rechtsgebiete tun. Daher kann es nicht verbieten, was das Verwaltungsrecht erlaubt, muß aber auch nicht jedes verwaltungswidrige Verhalten bestrafen. Auf dieser Basis ergibt sich die Straflosigkeit wirksam genehmigten Handelns selbst bei rechtswidriger oder erschlichener Genehmigung. Regelungen wie § 330d Nr. 5 StGB verursachen Normwidersprüche und sind nichtig. Geduldetes Verhalten bleibt straflos, soweit die Duldung eine Tolerierung des Verhaltens beinhaltet. Verfassungsrechtlich unzulässig ist es, wenn erst ein Verwaltungsakt das strafbare Verhalten benennt. Zwar können bereits gesetzlich vorgesehene Pflichten behördlich konkretisiert werden, wie im Beispiel des § 327 StGB Untersagungen. Soweit das Gesetz indes nur unbestimmt "verwaltungrechtliche Pflichten" nennt (z. B. § 325 StGB), genügt dies nicht Art. 103 II GG. Eine Verhaltensverpflichtung führt auch nur dann zur Strafbarkeit, wenn der Verwaltungsakt vollziehbar und rechtmäßig ist, weil allein dies die Rechtsgutgefährdung bei Zuwiderhandlung gewährleistet.
