Mit der Umsetzung der Warenkauf- und Digitale Inhalte-Richtlinie in das BGB halten smarte Produkte Einzug in das nationale Kaufrecht. Weitgehend ungeklärt ist bisher, wie genau digital angereicherte Funktionen dieser Gegenstände ausgestaltet sein müssen, um unter das Kaufrechtvertragsrecht zu fallen. Die Beantwortung dieser Fragen hängt maßgeblich von den zugrundeliegenden, technisch-ökonomischen Zusammenhängen, den sogenannten digitalen Geschäftsmodellen, ab. Davon ausgehend rückt diese Arbeit die produktbezogenen Leistungsinhalte für die vertragstypologische Einordnung sowie Konkretisierung des kaufrechtlichen Mangelbegriffs in den Vordergrund und adressiert anschließend Folgefragen, insbesondere im Zusammenhang mit der Nacherfüllung. Im Ergebnis wird vorgeschlagen, auf die substanzbezogenen und funktionsprägenden Leistungsbestandteile abzustellen, um eine anwendungsübergreifende Zuordnung smarter Produkte zum Kaufvertragsrecht zu ermöglichen - unabhängig vom einem Verbraucherbezug.
