This book introduces a new conceptual framework for impunity within state crime theory and uses Turkish state criminality against Kurds between 1990 and 2000 as a case study. It develops an understanding of impunity that goes beyond viewing the state solely as an actor, facilitator, or denier of crime. It argues for an expanded definition of state crime to encompass criminal acts and processes undertaken by states, including impunity.Building on field research, case analysis, and interviews, this book digs deep into the mechanics of impunity and ways in which the Turkish state has evaded punishment for its criminal acts. In doing so, Framing Impunity in the Context of State Crime uncovers a close connection between the crimes of the government and the impunity which allowed those crimes to flourish. It demonstrates that state violence and impunity are endemic in the structural design of the Turkish state and serve to further both the state goals of ethnic and religious assimilation and the subsequent persecution of those who refused to be assimilated into the new state construction. The book uses Stanley Cohen's work on states of denial techniques to examine how states justify their illegal acts in order to deny and/or to evade responsibility for their crimes. This interdisciplinary book constitutes the first major and comparative study of resilience focused on victims-/survivors of conflict-related sexual violence (CRSV). It applies the framework to its analysis of rich empirical data from Bosnia-Herzegovina, Colombia and Uganda, and it tells a set of stories about resilience through the contextual, dynamic and storied connectivities between individuals and their social ecologies. Ultimately, it utilises the three elements of the framework – namely, broken and ruptured connectivities, supportive and sustaining connectivities and new connectivities – to argue the case for developing the field of transitional justice in new social-ecological directions, and to explore what this might conceptually and practically entail. The book will particularly appeal to anyone with an interest in, or curiosity about, resilience, and to scholars, researchers and policy makers working on CRSV and/or transitional justice. The fact that resilience has received surprisingly little attention within existing literature on either CRSV or transitional justice accentuates the significance of this research and the originality of its conceptual and empirical contributions. This book examines whether and how non-state armed groups might be required to provide reparations for the harm caused by their violations of international law committed during situations of non-international armed conflict. Most of today’s armed conflicts are waged between states and non-state armed groups or between such groups. Societies ravaged by these conflicts endure extensive harm resulting from violations of international humanitarian law and international human rights law. This reality prompts a series of pressing questions. Akin to states, should non-state armed groups be held responsible for making reparation when violating international law? And if so, what measures can these groups take to repair the harm they have caused? The book begins by clarifying if there exists, in contemporary international law, a duty for armed groups to provide reparation. It considers whether non-state armed groups have primary international obligations as distinct duty bearers, and whether reparation can be one of the legal consequences when violating these obligations. Subsequently, the book sheds new light on how non-state armed groups’ duty of reparation can be operationalised in international law. This involves elucidating both the conceptualisation and practical application of this duty. Combining this legal analysis with practical perspectives, the book unveils important insights for international law, drawn from an in-depth analysis of Colombia’s experiences with reparations by armed groups in the context of transitional justice. This book will be of interest to scholars and practitioners working in the fields of international law related to armed conflict, accountability and redress, and transitional justice more broadly.

While the flames of World War II still raged, Roosevelt, Churchill, and Stalin issued a warning to the Nazi leaders. The Brotherhood, backed by virtually unlimited funds, established "safe" houses inside Germany, escape routes to other countries and continents, and an extensive international group of industrial firms as financial reservoirs and as "fronts" for escaped Nazis. This chronicle, based upon independent investigation, including numerous exclusive interviews and the examination of declassified and revealing documents, casts a new light upon Bormann, his strange role in the Third Reich, and his devastating influence, which cuts mercilessly into our present. This is essential reading, as fascinating as it is meaningful.

Yet a number of key questions about this tragedy remain unanswered: How did the violence spread from community to community and so rapidly engulf the nation? Why did individuals make decisions that led them to take up machetes against their neighbors? And what was the logic that drove the campaign of extermination?According to Scott Straus, a social scientist and former journalist in East Africa for several years (who received a Pulitzer Prize nomination for his reporting for the Houston Chronicle), many of the widely held beliefs about the causes and course of genocide in Rwanda are incomplete. They focus largely on the actions of the ruling elite or the inaction of the international community. Considerably less is known about how and why elite decisions became widespread exterminatory violence.Challenging the prevailing wisdom, Straus provides substantial new evidence about local patterns of violence, using original research—including the most comprehensive surveys yet undertaken among convicted perpetrators—to assess competing theories about the causes and dynamics of the genocide. Current interpretations stress three main causes for the genocide: ethnic identity, ideology, and mass-media indoctrination (in particular the influence of hate radio). Straus's research does not deny the importance of ethnicity, but he finds that it operated more as a background condition. Instead, Straus emphasizes fear and intra-ethnic intimidation as the primary drivers of the violence. A defensive civil war and the assassination of a president created a feeling of acute insecurity. Rwanda's unusually effective state was also central, as was the country's geography and population density, which limited the number of exit options for both victims and perpetrators.In conclusion, Straus steps back from the particulars of the Rwandan genocide to offer a new, dynamic model for understanding other instances of genocide in recent history—the Holocaust, Armenia, Cambodia, the Balkans—and assessing the future likelihood of such events.

In doing so, Feierstein examines the contributions of various disciplines to comprehending memory processes and social representations. It covers a range of topics, from the nature of memory based on the neuroscientific discoveries of the last half-century to psychoanalytic theories on the functioning of the mind, including the role of psychic defense mechanisms, the unconscious mind, collective pacts of denial and different forms of desensitization.
